Effective Date: January 1, 2025
These Terms & Conditions (“Terms”) govern all transportation and logistics services provided by FreightZap (“FreightZap,” “we,” “our,” or “us”). By tendering freight to FreightZap, the Customer agrees to be bound by these Terms.
FreightZap arranges and coordinates transportation and related logistics services through a network of qualified third-party carriers and service providers.
Rates are based on the shipment details provided at the time of booking. Additional charges may apply if actual shipment requirements differ from those originally provided or if accessorial services are incurred during transportation. These may include, but are not limited to, detention, layover, reconsignment, and specialized handling.
Payment is due in accordance with the terms specified on the applicable invoice.
All freight charges are considered earned upon dispatch of the shipment.
Payment for transportation services is separate from any cargo claims or service-related disputes. FreightZap is committed to working collaboratively with customers to promptly review and resolve any concerns or discrepancies.
FreightZap will provide Proof of Delivery (POD) and all applicable shipment documentation for each completed shipment.
Customers are responsible for reviewing invoices upon receipt. Any discrepancies must be reported in writing within five (5) business days. If no notice is provided within this timeframe, the invoice will be deemed accurate and accepted.
All claims for loss or damage must be submitted in writing within the applicable legal timeframes and must include supporting documentation. FreightZap will assist in coordinating the claims process with the responsible carrier.
FreightZap acts solely as a transportation coordinator and utilizes third-party carriers. Liability for loss or damage is governed by applicable laws and the terms and conditions of the performing carrier.
FreightZap shall not be liable for any indirect, incidental, or consequential damages.
Transit times are estimates only and are not guaranteed. Shipments may be impacted by factors outside of FreightZap’s control, including but not limited to weather conditions, traffic, mechanical issues, operational constraints, or delays caused by the shipper or consignee.
Accessorial charges may apply based on shipment conditions, including but not limited to delays, changes in instructions, detention, layover, or additional service requirements encountered during transit.
FreightZap utilizes available tracking technologies to provide shipment visibility. Tracking availability and accuracy may vary depending on carrier systems, technology integrations, and connectivity.
For temperature-sensitive shipments, equipment is expected to be set according to the instructions provided by the shipper. FreightZap supports monitoring through available tracking and carrier systems; however, performance may be affected by factors outside of FreightZap’s control, including but not limited to loading practices, packaging, and external conditions.
Past due balances may be subject to a service charge of one and one-half percent (1.5%) per month, or the maximum rate permitted by applicable law.
FreightZap reserves the right to take appropriate actions to recover outstanding balances, including but not limited to engaging third-party collection agencies or pursuing legal remedies.
FreightZap reserves the right to establish, review, modify, or revoke credit terms at its sole discretion based on account activity, payment history, or creditworthiness.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
These Terms, together with any applicable invoices, rate confirmations, and shipment documentation, constitute the entire agreement between the parties unless otherwise agreed to in writing.
FreightZap reserves the right to update or modify these Terms at any time. Continued use of FreightZap’s services following any changes constitutes acceptance of the revised Terms.
